Trusts of Land Update: Tuesday 18/Monday 24 November, 9.30 – 1.00pm For the more experienced practitioner looking to keep up to speed with the latest developments since Stack v Dowden. We will look at all of the important sole name and joint names cases in 2008 and assess where the law is going. 3 CPD points: £85 + VAT including refreshments and handout. Divorce, Debt and Insolvency: Thursday 20/Tuesday 25 November, 9.30 – 1.00pm Most of us working in the field of relationship separation are already seeing debt and insolvency forming a substantial part of some disputes, and the forecasts for next year make grim reading. The moral, as always, is "be prepared". We will cover the important recent cases of Avis v Turner and Hill v Haines, among others, and also look at what you can do if your client is facing action by a mortgagee, including repossession claims. 3 CPD points: £85 + VAT, including refreshments and handout. Mental Capacity and Property: Wednesday 26 November, 9.30 – 1.00pm The Mental Capacity Act and the new Court of Protection have now been with us for just over a year and their impact is already being felt, particularly in decisions about testamentary capacity and undue influence. What does the case law so far tell us about the prudent steps to take when advising either an attorney or a client with doubtful capacity? What practical problems might you encounter?
